Terms of Use

Please read carefully. These Terms contain important disclaimers of warranty, limitations of liability, indemnification obligations, a binding arbitration agreement, and a class-action waiver. By using AwareCAD, you agree to these Terms.

1. Acceptance of these Terms

These Terms of Use (the "Terms") form a binding legal agreement between you ("you" or "User") and Meridian Operations LLC, a Texas limited liability company that provides the AwareCAD service ("we," "us," or "our"). They govern your access to and use of the AwareCAD web application, marketing site, subdomains under awarecad.com, and any related service or API we publish (collectively, the "Service" or "AwareCAD").

AwareCAD is a product / service provided by Meridian Operations LLC. References to "AwareCAD" in these Terms describe the Service. The contracting party in this agreement is Meridian Operations LLC.

By creating an account, signing in, accessing, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Eligibility

You may use the Service only if all of the following are true:

  • You are at least 13 years old.
  • If you are under 18, your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
  • You can form a legally binding contract with us under applicable law.
  • You are not barred from receiving the Service under the laws of the United States or your jurisdiction.
  • You are not located in, ordinarily resident in, or organized under the laws of, any country or region subject to comprehensive United States sanctions.

We reserve the right to refuse service, terminate accounts, or remove or edit content at any time, in our sole discretion, for any reason or no reason.

3. Description of the Service

AwareCAD is a web-based Computer-Aided Dispatch and Mobile Data Terminal (CAD/MDT) tool for roleplay communities playing Emergency Response: Liberty County ("ER:LC") on Roblox. The Service is provided solely for fictional gameplay and entertainment.

AwareCAD is not:

  • Real law-enforcement software.
  • Approved for actual police, fire, or emergency-services use. It does not meet any of the standards real public-safety software has to meet (such as CJIS, the FBI's rulebook for criminal-justice information systems).
  • Affiliated with, endorsed by, or sponsored by Roblox Corporation, Police Roleplay Community, or any other game publisher, government agency, or law-enforcement organization.

You agree not to use the Service for any real public-safety, criminal-justice, or governmental purpose, and not to enter real personally identifying or criminal-record data of any actual person into the Service.

4. Beta service; no service-level guarantees

The Service is provided on an "alpha," "beta," "early access," or otherwise pre-release basis. Features may be added, changed, delayed, suspended, broken, or removed at any time without notice.

We provide no service-level agreement (SLA), no uptime commitment, no recovery-time objective, no recovery-point objective, and no maintenance guarantees. We may take the Service offline for any reason, including but not limited to maintenance, debugging, infrastructure changes, cost reduction, or because we decided to. You accept that data loss is a real and material possibility.

5. Accounts

You may need to register an account to use the Service. You are responsible for:

  • Providing accurate information during sign-up.
  • Safeguarding your authentication credentials, including the credentials of any third-party identity provider you link (Discord, Roblox).
  • All activity that occurs under your account, whether or not authorized by you.
  • Notifying us promptly at support@awarecad.com of any unauthorized access.

We are not liable for any loss arising from unauthorized access to your account that was not caused by our gross negligence.

6. Subscriptions and billing

AwareCAD offers a free tier ("Recruit") and paid subscription tiers (currently "Patrol," "Command," and "Headquarters"). Each ER:LC server you operate as a community owner requires its own subscription; one paid tier does not extend to multiple linked communities or servers.

6.1 Payment processor

Subscriptions are billed through Stripe, Inc. ("Stripe"), which acts as our payment processor. By subscribing, you also agree to Stripe's Stripe Services Agreement. You provide your payment-instrument details directly to Stripe through a Stripe-hosted checkout; Meridian Operations LLC does not see, store, or transmit your card number. See Section 2.5 of our Privacy Policy for what we do receive.

6.2 Auto-renewal

Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan you select) and automatically renew at the end of each billing period unless you cancel before the renewal date. The billing amount and frequency are shown to you on the Stripe checkout page and in your community's billing settings at any time via the Stripe Customer Portal.

6.3 Cancellation

You may cancel a subscription at any time from the Stripe Customer Portal (linked from /admin/community-settings while signed in as an owner). Cancellation takes effect at the end of the current paid period; your community retains access to the paid tier's features until that date, after which it reverts to the Recruit (free) tier. Cancellation does not delete your community, your members, or your data.

6.4 Refunds

14-day money-back guarantee on your first paid subscription. If you upgrade from Recruit to a paid tier (Patrol, Command, or Headquarters) and decide within fourteen (14) calendar days of that first charge that AwareCAD isn't the right fit, email support@awarecad.com from the email on your account and we'll refund the most recent charge in full, no questions asked. The guarantee applies once per Stripe customer.

Outside the 14-day window, subscriptions are billed in advance and renewals are non-refundable. Cancelling stops the next renewal but does not refund the current period β€” your community keeps paid-tier access until the end of the billing period you've already paid for, then drops to Recruit. Downgrading to a lower tier mid-cycle does not generate a prorated refund.

We may, in our sole discretion and outside the policy above, issue a refund or credit if required by applicable consumer-protection law or for documented service outages affecting your billing period.

6.5 Failed payments

If a renewal payment fails, Stripe will retry the charge for a limited period (per Stripe's standard dunning schedule). During that grace period your community retains access to the paid tier. If retries continue to fail, your community automatically downgrades to the Recruit (free) tier. You can restore paid features by updating your payment method in the Customer Portal at any time.

6.6 Price changes

We may change subscription pricing at any time. Any price change applies to future billing periods only and will be communicated to existing subscribers by email and/or in-app notice at least thirty (30) days before it takes effect. If you do not agree to a new price, your sole remedy is to cancel before the new price takes effect.

6.7 Taxes

You are responsible for any sales tax, value-added tax, or similar taxes applicable to your subscription, except where Meridian Operations LLC is required by law to collect such tax on your behalf. Where we are required to collect tax, the tax amount will be shown on the Stripe checkout page and on your invoice.

6.8 Chargebacks

If you initiate a chargeback or payment-dispute with your card issuer for a charge that we believe to be valid, we may suspend or terminate your account and any associated community immediately while the dispute is pending, and we may permanently terminate access if the dispute is resolved in our favor. If you believe a charge is incorrect, contact us at support@awarecad.com before initiating a chargeback so we can investigate.

6.9 Free trials and promotions

From time to time we may offer free trials or promotional pricing for paid tiers. Trial and promotional terms (duration, eligibility, conversion behavior) will be presented at the time of the offer and form part of these Terms with respect to that offer. Unless stated otherwise, a free trial converts to a paid subscription at the end of the trial period at the then-current standard price; you may cancel before the trial ends to avoid being charged.

6.10 Beta status applies to paid tiers

The disclaimers and limitations in Section 4 (Beta service) apply equally to paid subscriptions. Paying for a tier does not create a service-level agreement, uptime commitment, or warranty beyond those expressly stated in these Terms.

7. Acceptable use

You agree not to, and not to attempt to:

  • Use the Service for any unlawful, infringing, or harmful purpose.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Harass, threaten, intimidate, stalk, or harm any other user or third party.
  • Upload, post, or transmit content that is unlawful, defamatory, obscene, hateful, sexually explicit, or otherwise objectionable.
  • Upload real personal data of any actual person, including but not limited to government-issued identifiers, real criminal-record data, real medical data, or biometric data.
  • Use the Service to facilitate cheating, exploits, scams, spam, phishing, or malicious software in any game.
  • Probe, scan, or test the vulnerability of the Service except as part of a coordinated security disclosure pre-authorized by us in writing.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service except to the extent required by law.
  • Use the Service to build a competing product or to train a machine-learning model.
  • Resell, sublicense, or otherwise commercially exploit the Service without our prior written consent.
  • Bypass, disable, or otherwise circumvent any security or access control of the Service, our subprocessors, or any game we integrate with.
  • Use automated means (bots, scrapers) to access the Service without our prior written consent.

Violation may result in immediate termination, deletion of your content, and reporting to law enforcement where appropriate.

8. User Content

You retain ownership of any content you submit to the Service β€” including civilian profiles, vehicle registrations, citations, BOLOs, warrants, arrest reports, incident reports, field notes, calls, narratives, and community settings ("User Content").

You grant us a worldwide, royalty-free, non-exclusive, perpetual, irrevocable, sublicensable license to host, store, copy, reproduce, transmit, display, modify (only for technical purposes such as resizing or reformatting), and distribute User Content to the extent necessary to operate and improve the Service. This license terminates with respect to User Content you delete from your account, except for residual copies retained in backups for the period described in our Privacy Policy and except to the extent the User Content has already been incorporated into another community member's records (e.g., a citation you issued remains in their record after your account is deleted; your authorship is anonymized).

You represent and warrant that you own or have all necessary rights to submit your User Content and that doing so does not violate any third-party right or applicable law.

9. Our intellectual property

The Service, its source code, design, layouts, graphics, text, and all related intellectual property (other than User Content and content owned by our subprocessors or game publishers) are owned by us or our licensors and protected by copyright, trademark, and other laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial roleplay use. All rights not expressly granted are reserved.

"AwareCAD" and any logo or wordmark we use are trademarks of the Operator. You may not use them without our prior written consent.

10. Roblox-specific terms

The Service integrates with Roblox via Roblox's OAuth 2.0 program and public APIs. The following provisions apply specifically to your use of Roblox-integrated features and are required by Roblox's Creator Third Party App Terms:

  1. You must agree to and comply with the Roblox Terms of Use, Roblox Community Standards, and any other Roblox-published policies (collectively, the "Roblox Terms") at en.help.roblox.com.
  2. These Terms are between you and Meridian Operations LLC (operator of the AwareCAD service) only, and not with Roblox Corporation.
  3. Roblox is not affiliated in any way with Meridian Operations LLC or the AwareCAD service. AwareCAD is an independent third-party application provided by Meridian Operations LLC.
  4. Roblox is not responsible or liable for any party's use of, access to, or inability to use the Service.
  5. Roblox has no obligation to provide any maintenance or support services for the Service.
  6. By using or accessing the Service, you acknowledge and agree that you waive and release any and all claims, liabilities, damages, losses, and expenses against Roblox Corporation arising from or related to the Service.

If the Service later integrates with additional game publishers, equivalent waivers and disclaimers will apply. We expressly disclaim affiliation with any game publisher whose platforms or trademarks the Service may reference.

11. Third-party services

The Service depends on third-party platforms, including but not limited to Supabase, Cloudflare, Roblox, and Discord. We do not control these third parties. Their availability, terms, and policies may change at any time, which may affect or interrupt the Service. We disclaim any liability arising from any third party's act, omission, outage, security incident, policy change, or termination of relationship with us.

12. Termination and suspension

We may, in our sole discretion and without notice, suspend or terminate your access to the Service, delete your account, and delete or anonymize your User Content, for any reason or no reason, including (without limitation) if we believe you have violated these Terms, our Privacy Policy, the Roblox Terms, or any applicable law.

You may terminate these Terms at any time by deleting your account at /settings/data after signing in or by emailing support@awarecad.com. Upon termination, your right to access the Service ceases immediately. Sections that by their nature should survive termination (including without limitation Sections 8–18) will survive.

13. DMCA / copyright

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice in writing to support@awarecad.com containing the information required by 17 U.S.C. Β§ 512(c)(3): (a) identification of the copyrighted work; (b) identification of the allegedly infringing material with sufficient information for us to locate it; (c) your contact information; (d) a statement of good-faith belief that use is not authorized; (e) a statement under penalty of perjury that the information in the notice is accurate and that you are authorized to act; and (f) your physical or electronic signature.

14. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS." TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or that defects will be corrected. We do not warrant the accuracy, completeness, or reliability of any content available through the Service. You use the Service entirely at your own risk.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MERIDIAN OPERATIONS LLC, ITS MEMBERS, MANAGERS, OFFICERS, AFFILIATES, OR LICENSORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE AWARECAD SERVICE, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE AWARECAD SERVICE, REGARDLESS OF THE FORM OF ACTION, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU ACTUALLY PAID MERIDIAN OPERATIONS LLC FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE U.S. DOLLAR (US$1.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless Meridian Operations LLC and its members, managers, licensors, and subprocessors, and each of their respective officers, directors, employees, agents, contractors, and affiliates, from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your access to or use of the Service;
  • Your violation of these Terms, the Privacy Policy, the Roblox Terms, or any applicable law;
  • Your User Content, including any claim that it infringes a third party's right;
  • Your interactions with other users or with any community on the Service;
  • Any misrepresentation made by you.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with us. You may not settle any claim without our prior written consent.

17. Dispute resolution; arbitration; class-action waiver

16.1 Informal resolution first

Before filing a claim, you agree to attempt to resolve the dispute informally by emailing support@awarecad.com a written description of the dispute and your contact information, and to negotiate in good faith for at least sixty (60) days.

16.2 Binding arbitration

If we can't work the dispute out informally, you and Meridian Operations LLC agree that any dispute, claim, or controversy related to these Terms or the AwareCAD service (each a "Dispute") will be resolved by a private arbitration process rather than in court. The arbitration will be run by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Small claims that qualify can still be brought in small-claims court if you prefer. The arbitration will be held in Travis County, Texas, or by video call if the arbitrator agrees. The arbitrator's decision is final and can be enforced in any court that has jurisdiction.

16.3 Class-action waiver

YOU AND MERIDIAN OPERATIONS LLC AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE-ATTORNEY-GENERAL ACTION OR PROCEEDING.

16.4 Opt-out

You may opt out of the arbitration agreement in Section 17.2 and the class-action waiver in Section 17.3 by emailing support@awarecad.com within 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and your account email in the body. Opting out does not affect any other part of these Terms.

18. Governing law and venue

These Terms and any Dispute will be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws principles, and applicable U.S. federal law. To the extent any Dispute is not subject to arbitration under Section 17, you and Meridian Operations LLC agree to submit to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas, and you waive any objection to such venue.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

19. Force majeure

We will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including without limitation acts of God, natural disasters, war, terrorism, civil unrest, pandemics, government action, internet or telecommunications outages, cyberattacks, denial-of-service attacks, third-party service outages, or labor disputes.

20. Changes to these Terms

We may modify these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated by email or by a prominent in-app notice at least seven (7) days before they take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree, stop using the Service.

21. Miscellaneous

20.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AwareCAD concerning the Service and supersede all prior or contemporaneous communications, whether electronic, oral, or written.

20.2 No waiver

Our failure to enforce any right or provision will not be considered a waiver of that right or provision.

20.3 Severability

If any provision of these Terms is held invalid or unenforceable by an arbitrator or court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

20.4 Assignment

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms freely, including to any successor in interest, without notice.

20.5 No third-party beneficiaries

Except as expressly stated (including in Section 10 with respect to Roblox Corporation, which is an intended third-party beneficiary of Section 10 only), these Terms confer no rights on any third party.

20.6 Headings

Section headings are for convenience only and have no legal effect.

20.7 Electronic communications

You consent to receive communications from us electronically (email, in-app notice, posting to the Service) and agree that such communications satisfy any legal requirement that communication be in writing.
